A member family in Macon County, Illinois, started homeschooling in January of 2008. Later that month, the Macon-Piatt Regional Office of Education (ROE) told the family that they had been informed that education was not occurring in the home. The ROE then told the family that they had to provide the district with (1) proof that instruction commensurate with the public school is being provided, (2) documentation of subjects taught, (3) an annual calendar and daily schedule, and (4) proof that the child’s level of academic achievement is comparable to that of the child’s peers.

On January 1, 2008, SB 777 became law in California. SB 777 deals primarily with what constitutes discrimination against homosexuals in schools. Many questions have been asked about the impact of SB 777, what it has changed, and whether or not it affects private schools, including private home schools. SB 777 changed numerous sections in the Education Code. The most significant changes to four sections in the Education Code are explained in a new detailed analysis, which has been prepared by Private and Home Educators of California in conjunction with attorneys at Home School Legal Defense Association.

This new analysis attempts to answer many of the questions that have been asked about SB 777. Concerned that their local public school district was requesting
additional information, a member family contacted us for help. We
showed officials that their request went beyond what the law requires
and that the family's paperwork was in order.

Member families with fewer than six students enrolled in their private school received copies of a letter from the Morongo Unified School District. The letter alarmed some of our members. It was from the Coordinator of Child Welfare and Attendance. The letter references each parents’ filing of a Private School Affidavit to establish a private school in their homes. The letter also includes a summary of the law pursuant to Education Code §48222 and §33190.
